1. Acceptance of These Terms
These Terms of Service ("Terms") form an agreement between you and Dialysis Centers Directory LLC, a California limited liability company ("we," "us," or "our"). They govern your use of dialysiscenters.org and any of its subdomains (the "Site").
By accessing, browsing, or otherwise using the Site, you agree to these Terms, whether or not you ever contact us. If you do not agree, do not use the Site.
Automated access. Accessing the Site with a script, bot, crawler, scraper, or other automated tool is use of the Site, and whoever operates that tool agrees to these Terms. Sections 7 and 8 govern automated access.
Changes. We may revise these Terms. Continuing to use the Site after a revision is posted means you accept it. Section 15 covers changes and notices.
Related documents. Your use of the Site is also governed by our Privacy Policy and our Consumer Health Data Notice.
2. What This Site Is
The Site is an informational directory of dialysis facilities in the United States, built from public data published by the Centers for Medicare & Medicaid Services ("CMS"). Section 4 describes those sources.
The Site is for information only. It is not medical advice and is not a substitute for care from a qualified health professional. Using the Site does not create a professional relationship between you and us. If you are having a medical emergency, call 911.
We do not arrange, broker, or place patients for treatment, and we do not contact facilities on your behalf.
3. Eligibility
The Site is intended for use in the United States and its territories. We make no representation that it is appropriate or available elsewhere.
The Site is not directed to children under 13.
4. Data Sources and Non-Affiliation
Facility information on the Site comes from public data published by the Centers for Medicare & Medicaid Services ("CMS") at data.cms.gov. You can obtain that data directly from CMS.
We are not affiliated with CMS, Medicare, the U.S. Department of Health and Human Services, or any other government agency, and nothing on the Site is endorsed or approved by any of them.
We are not affiliated with any dialysis provider, facility, or chain. Facility and operator names and marks appear on the Site only to identify them, and belong to their respective owners.
5. Accuracy and Currency of Information
The information on the Site comes from CMS data and may be incomplete, out of date, or superseded. CMS data is reported on a delay, and facility details can change at any time.
CMS is the authoritative source. Before relying on anything here, confirm it with the facility or with CMS.
6. Corrections
If you believe something on the Site is wrong, write to us at support@dialysiscenters.org.
Facility information on the Site comes from CMS. Where a CMS value itself is inaccurate, the correction has to come from CMS; the corrected value will appear here after CMS publishes it and we refresh our data.
We are under no obligation to remove a facility from the Site on request. The information we publish is public data about licensed healthcare facilities.
7. Use of the Site and Content
CMS data. The facility information on the Site comes from public datasets published by CMS. That data is in the public domain. We do not claim to own it, and you can get it directly from CMS. Section 4 tells you where.
Our own work. Everything else on the Site is ours: the content we write, the design and layout, our logo, and the way we organize facilities into metropolitan and local areas — including which facilities are assigned to which area. Our selection and arrangement of this information is a protected compilation, even though the underlying CMS data is not.
How you may use the Site. You may use the Site for your own personal, non-commercial purposes, including reading, printing, and sharing individual pages. You may not use a bot, crawler, scraper, or other automated tool to extract or collect data from the Site in bulk. You may not copy or redistribute our written content, our design, or our area organization. Search engines may crawl the Site as permitted by our robots.txt file.
AI training. We do not consent to the use of our content for training, fine-tuning, or evaluating machine learning models. This applies to our written content, our design, and our area organization. It does not apply to the CMS data, which is public.
8. Prohibited Uses and Access
In addition to the limits in Section 7, you may not:
- interfere with the operation or security of the Site, or attempt to gain unauthorized access to any part of it;
- circumvent rate limits, access controls, or other technical measures;
- use the Site in a way that misrepresents a connection with us; or
- use the Site for any unlawful purpose.
We may block, rate-limit, or revoke access to the Site at any time, with or without notice.
9. Third-Party Links
The Site links to facility websites, CMS, and other third-party resources. We do not control those sites and are not responsible for their content, availability, or practices. A link is not an endorsement.
10. Feedback
Anything you send us — including suggestions, comments, and corrections — is not confidential. We may use it for any purpose, without compensating or crediting you.
11. Disclaimers
The Site and everything on it are provided "as is" and "as available." We make no warranty that the information on the Site is accurate, complete, or current, and no warranty that the Site will be available or error-free.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any damages arising from your use of or reliance on the Site.
Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100).
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense, including reasonable attorneys' fees, arising from your use of the Site, your breach of these Terms, or your violation of any law or the rights of any third party.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Any dispute relating to these Terms or the Site must be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of those courts.
Any claim relating to the Site must be brought within one year after it arises.
15. Changes and Notices
We may revise these Terms at any time. A revised version takes effect when we post it, and we will update the "Last updated" date. Changes do not apply retroactively to a dispute that arose before the change.
Notices to us may be sent to support@dialysiscenters.org or to the address in Section 17.
16. General Provisions
If any part of these Terms is found unenforceable, the rest remains in effect.
Our failure to enforce any part of these Terms is not a waiver of it.
We may assign these Terms. You may not.
Sections 7, 11, 12, and 13 survive any termination of your access to the Site.
These Terms, together with our Privacy Policy and Consumer Health Data Notice, are the entire agreement between you and us regarding the Site.
